entered in the Companies Register of Madrid under Section 8, sheet
138,049 (information supplied in accordance with the provisions of
article 10 of Information Society Services and Electronic Commerce
Act 34/2002) is using the
http://www.hcceurope.com website (hereinafter, the website)
which is made available to Internet users in order to provide
information on the services rendered by HCC EUROPE.
The domain name hcceurope.com has been registered by HCC Service
Company with registered office in Houston, Texas 77040, 13403
Northwest Freeway.
2. HCC domain names notified to the relevant Registers
HCC EUROPE hereby declares that the Companies Register of Madrid has
been notified of the domain names currently in use in accordance
with the provisions of article 9 of Information Society Services and
Electronic Commerce Act 34/2002, 11th July.
3. General Terms of Use and Acceptance thereof
The object of these general terms for using the website along with
such specific terms as may be established is regulating and
informing users of the services provided by the company HCC and
regulating use of the website.
By accessing and using the website services, the User full
unreservedly accepts all the general terms of use, the general terms
of business and such others as may be in place in relation to the
provision of services by HCC.
HCC may at any time and without notice change these general terms
and such others as may be included by posting amended general terms
at the website in order that users may previously become acquainted
with them. Notice of any amended term shall be posted on the
website’s main page for as long as may be deemed reasonable.
GENERAL TERMS OF USE OF THE WEBSITE
1. Cookies:
The HCC website only uses cookies in the website to collect
non-personal usage data. No personal data are being collect through
the website. Should their use be envisaged in the future, HCC
undertakes to properly inform the user of their existence and of the
means available for the user to disable the same.
2. Intellectual Property. Hyperlinks Policy
2.1. All the contents included at the website and in particular the
trade marks, trade names, industrial designs, designs, texts,
photographs, graphics, logotypes, icons, software or any other signs
capable of being used industrially and commercially are protected by
intellectual property rights of HCC or third-party proprietors who
have authorised their inclusion at the website. Any use and/or
reproduction of the same without the express consent of HCC is
therefore forbidden.
2.2. HCC shall not be liable for the infringement of third-party
intellectual property rights derived from the inclusion at the
website of trade marks, trade names, industrial designs, patents,
designs, texts, photographs, graphics, logotypes, icons or software
belonging to third parties purporting to be their owners upon their
inclusion at the website.
2.3. User access and browsing shall at no event imply an
authorisation or a total or partial waiver, transfer, assignment of
those rights nor the grant of any right or prospective right and
specifically, to alter, transform, utilise, reproduce, distribute or
publicly communicate those contents without the prior express
authorisation of HCC or of the relevant owners.
2.4. No link whatsoever may be established to the Portal from any
other websites without the prior express consent of HCC .
The links established shall always be to the main page of HCC or as
the case may be to whatever page is established by HCC , such link
to be absolute and complete in order for the User to be taken to the
HCC site with the main page being shown fully on screen.
2.5. HCC shall not be liable for the contents of the destination
websites established by links at the website nor indeed for the
infringements of third-party rights for which those sites may be
liable.
3. Liability of HCC
The User agrees and accepts that it shall be fully liable for the
use of the website and its services.
HCC declares that all necessary steps have been taken to the best of
its ability and as available in the state of the art to ensure
website operation and prevent the existence and transmission of
viruses and other components potentially harmful to the User.
4. User Obligations
The User agrees to use the website contents reasonably, properly and
lawfully and undertakes to refrain from:
a) Using the contents for purposes or resulting in effects contrary
to the Law, ethics and accepted principles of morality or public
policy.
b) Reproducing, copying, distributing, allowing public access
through any public communication whatsoever, transforming or
changing the contents, other than with the relevant owner’s

5. Applicable laws
The relations established between the User and the website owner
shall be governed by the provisions of the rules in force in the
matter of applicable laws and competent jurisdiction. Nevertheless,
where the law allows the parties to voluntarily submit to a forum,
HCC and the User, expressly waiving any other forum available to
them, hereby submit to the Courts and Tribunals of Madrid.
The rules laid down in Spanish Laws shall apply in any event.
